Terms and Conditions for Psychedelic Practitioner Foundations Programme 

The Course offered is a Foundation course and Participants cannot use any certificate(s) provided to provide any form or therapy or psychedelic therapy, or represent themselves as qualified professionals, including qualified in the use of psychedelic substances for therapeutic purposes. This is strictly prohibited 

Introduction 

These terms and conditionsestablish the legal framework governing the relationship between Clerkenwell Clinics Limited(registration number is 12568155whose registered office is at 120 Aldersgate Street 120Work.Life Farringdon, Aldersgate Street, London, England, EC1A 4JQ)("Company") and the individual ("Participant") enrolled in the ‘Psychedelic Practitioner Foundations Programme("Course"). By enrolling in any Course offered by the Company, Participants explicitly agree to adhereto these terms and conditions. 

Please read these terms carefully before you submit your application to us. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem and other important information 

Our acceptance of your order to use the services (i.e. the Course) will take place when we write to you to accept it at which point these terms and conditions will come into existence between you and us.These terms and conditionsalongside any other documents provided by us to you will make up the contract. 

Course Enrolment 

  • Participants must be over 18 to enrol on the Course. 

  • Participants must complete the Company's enrolment process to register for a Course.  

  • Enrolment is subject to availability and acceptance by the Company. 

  • Participants can only enrol in the Psychedelic Practitioner Foundations Programme if they are a healthcare professional and attest to such status, which will be considered definitive. 

  • The Company reserves the right to reject any enrolment application without providing reasons. 

Course Content 

  • The Company will provide Participants with access to Course materials, which may include written materials, videos, webinars, and other resources. 

  • The Company will provide the Participant with access to the learning platform via individual login credentials, which will be designated solely for the Participant's use and shall strictly not be shared with any third party. Furthermore, access to the learning platform shall necessitate Two-Factor Authentication to enhance security measures.Participants are responsible formaintaining the confidentiality of their Course login credentials 

  • Participants do not have the option to download any Course materials from the platform and are not permitted to share any Course materials. 

  • Access to Course materials remains valid for one year from the moment Participants are granted access to the learning platform.  

  • Course content is provided for educational purposes only. 

  • The Company reserves the right to update or modify Course content at any time without prior notice. 

Availability of the Website 

The Website is provided “as is” and on an “as available” basis. The Company uses industry best practices to provide a high uptime, including a fault-tolerant architecture hosted in cloud servers. We give no warranty that the Website or Facilities will be free of defects and / or faults and we do not provide any kind of refund for outages. We provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality. 

We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.  


Prohibited Use 

Participants unequivocallyagree not to use the training provided under these terms and conditions for the purpose of providing any form of therapy, coaching or psychedelic-assisted therapynor to use this course to hold themselves out as qualified professionalsin the field. This includes but is not limited to the application of psychedelic substances or techniques learned in the training for therapeutic purposes. Such use is strictly prohibited.   

 

Payment 

Participants must pay the applicable Course fees as specified by the Company.  

  • Prices displayed on our website are subject to change without notice. The price charged for a Course will be the price in effect at the time of order confirmation. Taxes, if applicable, will be added to your total.  

  • Course fees are non-refundableand are required to secure access to the Course. 

  • Payment will be taken via Stripe only. If you are unable to use this payment gateway please contact us at training@clerkenwellhealth.com.  

  • The fees charged by Stripe can be found at the following link: https://stripe.com/gb/pricing. Please note that we are not liable for any matters arising from the Participant's relationship with Stripe. 

  • Participants are responsible for any additional costs associated with the Course, such as materials or technology requirements. 

  • If payment for the services is not made as scheduled, the Company reserves the right to suspend the supply of the services until the outstanding amounts are settled. Notification of the suspension of service will be provided. Additionally, interest may be charged on overdue payments. 

  • If we, for any reason, do not accept your order, no payment shall be taken under normal circumstances. In any event, sums paid by you in relation to that order will be refunded within 14 calendar days.  

Participant Responsibilities and Course Completion 

  • Participants must have the legal capacity to enter into this agreement and participate in the Course. 

  • All information provided to the Company by the Participant during the enrolment process, including personal details and payment information, is accurate and complete. 

  • Participants must adhere to all Course guidelines and instructions provided by the Company.  

  • Participants must conduct themselves in a respectful manner towards instructors and fellow Participants. 

  • Participants are responsible for researching and understanding course prerequisites and requirements. 

  • Courses must be completed within the specified time from the booking date. 

  • In the event that the Company's performance of the services is affected by an event outside its control, the Company will contact the Participant as soon as possible to provide notification and will take steps to minimise the effect of the delay. 

  • In the event that the Company's performance of the services is affected by an event outside its control, including but not limited to technical or operational problems, minor technical or operational changes, or updates to reflect changes in relevant laws and regulatory requirements, the Company will contact the Participant as soon as possible to provide notification and will take steps to minimise the effect of the suspension. 

Certificate 

Participants are eligible to receive the following certifications: 

  • A certificate of completion (not requiring a passing mark). 

  • A passing certificate, requiring a minimum passing mark of 80% to advance to the next module. 


[In the case of a failed exam, the learner will be eligible for a resit at least one month later.  

Our certificates don't have a specific expiry date, but to ensure that knowledge is kept up-to-date with legislation and best practices, and to reduce skills fade, it is recommended that the knowledge is refreshed regularly. 

Data Privacy 


By engaging with our services, you consent to the use of your personal data as outlined in ourprivacy policy. 

We will use the personal information you provide us: 

  • to deliver the Course to you; 

  • to improve the Course and Course content and the marketing of the Course; 

  • to process your payment for the Course; 

  • to give you information about any of the services we offer, including promotional content, but you may stop receiving this at any time by contacting us. 

Your personal information will be processed in line with legitimate interest as a legal basis under the data protection legislation. 'Data protection legislation' means the Data Protection Act 1998, and from 25 May 2018, the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016), and any legislation which amends, extends, consolidates, re-enacts or replaces same, including any additional legislation or regulations that may be made pursuant thereto from time to time. 

We will only share your personal information with third parties where the law requires us to do so. 

The Participant agrees not to disclose any confidential information obtained during the training course to third parties without the Company's prior written consent. 

Discussion Forums 

Participants may have access to discussion forums within the learning platform which are subject to the following rules. If these rules are not adhered to, the Participant will be terminated from the Course without a refund. 

  • Participants must engage in respectful and courteous communication at all times. No personal attacks, insults, or offensive language is permitted. 

  • Discriminatory or harassing behaviour based on race, ethnicity, gender, religion, sexual orientation, disability, or any other characteristic is strictly prohibited. 

  • Participants must respect intellectual property rights. Do not post copyrighted material unless you have the right to do so, and always give proper attribution when referencing or quoting others' work. 

  • Do not disclose any confidential or proprietary information belonging to the learning platform or any other party without proper authorisation. 

  • Keep discussions relevant to the subject matter of the Course or learning materials. Avoid spamming, off-topic discussions, or irrelevant content. 

  • It is advised that submissions are made using the English language as we may be unable to respond to inquiries submitted in other languages. 

  • The means by which you identify yourself must not violate these Terms and Conditions or any applicable laws. 

  • You must not impersonate other people including employees and representatives of the Company or our affiliates.  

  • You must not use our system for unauthorised mass-communication such as “spam” or “junk mail”.  

  • Any information you send to us through our system may be modified by us in any way, and you hereby waive your right to be identified as the author of such information. Any restrictions you may wish to place upon our use of such information must be communicated to us in advance, and we reserve the right to reject such terms and associated information. 

  • We reserve the right to moderate discussions and remove any content that violates these rules or is deemedinappropriate, without prior notice.  

  • Users are encouraged to report any abusive, inappropriate, or offensive behaviour.  

Intellectual Property 

  • All Course materials provided by the Company, including but not limited to text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code, and software, are the property of the Company, our affiliates, or other relevant third parties.By continuing to use these materials, you acknowledge that such material is protected by applicable laws of England and Wales and International intellectual property and other laws. 

  • Participants may not reproduce, distribute, modify or adapt anyCourse materials. 

  • Any unauthorised use of Course materials may violate copyright, trademark, and other laws and could result in legal consequences. 

  • Participants agree to indemnify and hold us harmless for any use by you of any third party’s intellectual property or proprietary information displayed on the learning platform.  

Third Party Intellectual Property 

  • Unless otherwise expressly indicated, all Intellectual Property rights including, but not limited to, Copyright and Trademarks, in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable. 

  • Participants may not reproduce, copy, distribute, store, or in any other fashion re-use such material unless otherwise indicated or unless given express written permission to do so by the relevant manufacturer or supplier. 

Links to Other Websites 

This Course may contain links to other websites. Unless expressly states, these sites are not under the control of the Company or that of our affiliates. We assume no responsibility for the content of such websites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site within our Course does not imply any endorsement of the sites themselves or of those in control of them 

Accounts 

To access certain information in relation to this Course , you must create an Account, which will entail providing certain personal details and Payment Information. The required information may vary based on your use of the Course Website, as Payment Information may not be necessary until you intend to make a purchase. By continuing to use the Course Website, you represent and warrant that: 

  • All information you submit is accurate and truthful. 

  • You have permission to submit Payment Information where required 

  • You will keep this information accurate and up-to-date 

  • Your creation of an Account further affirms your representation and warranty. 

Account sharing 

We accept no liability for any losses or damages incurred as a result of sharing your Account details. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser. 

If you suspect that your Account details have been accessed by another person without consent, you should contact us immediately to suspend your Account and cancel any unauthorised orders or payments that may be pending. Please note that orders or payments can only be cancelled until the provision of Services has commenced. In the event that unauthorised provision begins before you notify us of the unauthorised nature of the order or payment, you will be charged for the period from the commencement of the provision of services until the date you notified us. 

Indemnification 

Participants agree to indemnify, defend (if requested) and hold harmless Clerkenwell, our group companies and their managers, directors, suppliers, partners and agents from and against any third party claims, demands, losses or expenses (including reasonable legal fees). arising out of or related to: 

 

(a) any breach of these terms and conditions by the Participant;  

b) any violation of applicable laws and regulations by the Participant;  

c) any claim arising from the Participant’s use of Course materials;  

d) any claim arising from the Participant’s participation in the Course. 

 

Your indemnification obligations will survive termination of these terms and conditions and your use of the services. 

 

Limitation of Liability 

  • The Company (along with any affiliated companies, suppliers, partners and agents) shall not be liable for any direct, indirect, incidental, punitive,special, or consequential damages arising out of or in any way connected with the Course. 

  • Participants waive the right to take legal action against us for any damages incurred in relation to the Course, regardless of whether such damages result in loss or injury. 

Contract Term and Termination 

  • The Company reserves the right to terminate a Participant's access to the Course for violation of these terms and conditions or for any other reason deemedappropriate by the Company.  

  • In the event of termination, Course fees are non-refundable. 

Relationship between us 

You and we agree that no joint venture, partnership, employment, contractor or agency relationship exists between us. 

 

Complaints 

Any complaints in relation to the Course can be made to training@clerkenwellhealth.com. 

Governing Law 

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. 

Amendments 

The Company reserves the right to amend these terms and conditions at any time. Amendments will be effective upon posting on the Company's website.
